These are the terms and conditions for www.pjandthehare.co.uk (Website). The Website is operated by PJ and The Hare (weus and our). We are a limited company, registered in England. Our registered company number is 10657206 and our registered office address is at P.J. AND THE HARE, High St, Cuckfield, Haywards Heath RH17 5JU

These T&Cs govern your use and purchase of goods from the website www.pjandthehare.co.uk .  By usage of this site you are deemed to be accepting these T&Cs. We reserve the right to change these T&Cs at any time, although no change would affect an existing order that had been made prior to change.

ORDERING 

We must receive payment for the whole of the price of the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an order confirmation email to you at the email address you provide on your order form. You will receive an order reference number. We are not obliged to accept your order and may, at our discretion, decline to accept any order. You do, however, acknowledge that by clicking on the "Place my Order" button, you enter into an obligation to pay for the Product(s) in the event that you order is accepted by us. After entering into the Contract, we will be under a legal duty to supply you with goods that are in conformity with the Contract.

PRICE

The prices payable for goods that you order are as set out in our website.

All prices exclude delivery costs, which will be automatically added to the total amount during checkout.

You should be aware that online transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declines to authorise payment for any reason. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee for which we are not responsible.

RETURNS / EXCHANGES / REFUNDS

Please see our separate returns policy. 

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident, postal strikes or custom problems.

FAULTY PRODUCTS 

If any Product you order is damaged or faulty when delivered to you, we may offer a repair, exchange or refund, as appropriate, in accordance with your legal rights. If you believe a Product was delivered damaged or faulty, you must inform us in writing, giving us your name, address and order reference.

RISK & TITLE

Products ordered will be at your risk from the time of delivery. Ownership of the Products ordered will also pass to you on delivery, provided full payment of all sums due in respect of the Products, including any delivery charges, has been received.

ORDER CANCELLATION

This and the following paragraph apply if you buy as a consumer as defined in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the “Regulations”). Provided the Regulations apply to the transaction concerned, then the following terms apply to the contract.

We now inform you that information relating to all aspects of our Goods is not in this document but in our marketing material, whether that is in the medium of Our Website or in hard copy.

The following rules apply to cancellation of your order:

  • If you have ordered Goods, and received them, you may cancel your order at any time within 14 days of the date you received them. You must tell us that you wish to cancel. You must also send the Goods back to us within that same 14 day period.

We will return your money subject to the following conditions:

  • we receive the Goods in a condition in which we can re-sell them at full price, in new condition, with labels and packaging intact.
  • you comply with our procedure for returns and refunds. We cannot return your money unless we know who sent them.

The option to cancel your order is not available:

  • if you purchase sealed goods which relate to health or hygiene, and they become unsealed after delivery, or cannot be re-sold for some other reason;
  • if they are a hard medium for a product in soft copy, which comes to you sealed and is returned to us unsealed.
  • if the Goods are somehow mixed with other goods so that we cannot identify or easily separate them.
  • You are responsible for the cost of returning the Goods. We have no obligation to refund to you, your cost of re-packing and returning the Goods.
  • In any of the above scenarios, we will return your money within 14 days.

CANCELLATION BY US 

We reserve the right to cancel the contract between us if we have insufficient stock to deliver the goods you have ordered. If we cancel your contract we will notify you by email and will credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

PRODUCT INFORMATION

Whilst we have taken reasonable steps to depict Products as accurately as possible through the photographs and other images featured on the Website, the detailing (such as colour, pattern and texture, etc.) you see on-screen will depend on your monitor and, as such, may not exactly reflect the actual detailing of a Product when you receive it.

PRIVACY

You acknowledge and agree to be bound by the terms of our privacy policy. 

FOREIGN TAXES & DUTIES

If you are not in the UK, we have no knowledge of, and no responsibility for, the laws in your country.

You are responsible for purchasing Goods which you are lawfully able to import and for the payment of import duties and taxes of any kind levied in your country.

INTERNET SECURITY

We cannot and do not guarantee that any content of the Website will be free from viruses and/or other code that may have contaminating or destructive elements. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to the safety and reliability of content.

PROMOTIONAL / OFFER CODES

The following conditions apply to all Promotion and Offer codes:

Only one code can be used per transaction.

Codes can only be applied to full price items (they are not available on sale items).

Codes are non-transferrable and no cash alternative is available.

Orders must be made prior to 23:59 on the closing date, if specified.

All offers are subject to stock availability.

Offers are subject to change at any time.

All other Terms and Conditions apply.

THIRD PARTY RIGHTS

Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the United Kingdom Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

INTELLECTUAL PROPERTY

We will defend the intellectual property rights in connection with our Goods and Our Website, including copyright in the Content whether provided by us or by any other content provider (including copyright in: text, graphics, logos, icons, images, audio clips, digital downloads, data, and software).

Except as set out below, you may not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the Content, in whole or in part.

You may not use our name or logos or trademarks or any other Content on any website of yours or that of any other person.

Subject to the other terms of this agreement, you may download or copy Content only for your own personal use, provided that you maintain all copyright and other notices contained in it. You may not store electronically any significant portion of any Content.

You must only use the Website and anything available from the Website for lawful purposes (complying with all applicable laws and regulations), in a responsible manner, and not in a way that might damage our name or reputation or that of any of our affiliates.

GOVERNING LAW

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

GENERAL

When we communicate with you we do so by email. You agree that email communications are contractually binding in the same way as properly signed and dated paper sent by post.

ENTIRE AGREEMENT

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
